Shortages & Damages

You must inform us of any damages or shortages within 24 hour of delivery!

For chocolate orders call the number on your delivery note.

Returns Policy Standard Items
Under the United Kingdom’s Distance selling Regulations, if you have received goods and have changed your mind about purchasing them, you may return the goods for credit subject to the following conditions:

1) You inform us within seven working days of receiving the product(s). 
2) You return the item(s) to us within 14 days. 
3) Goods are returned in a reasonable condition and in the original packaging. 

We advise all customers to sign, "NOT CHECKED" with the carrier if you have any doubts about damage upon delivery. Please note: damages and breakages must reported and confirmed by email, to Chocolate Falls within 48 hours. Under the 'Sales of Goods Act' these rules do not apply to Business to Business sales.

Returns Policy Bespoke Items
Any bespoke items that are delivered as described and are in good condition may not be refunded. Damaged items or delivery errors, will be exchanged free of charge. Bespoke orders cannot be cancelled once production has commenced. If bespoke goods are returned we reserve the right to charge you for re-delivery.

Costs 
We will reimburse any reasonable costs you incur in returning (authorised return only) the following items to us :

•items we delivered to you in error; 
•items which were damaged upon delivery or are defective or incorrect

You will be responsible for the costs of returning items to us in all other circumstance, (including if you exercise your right to withdraw your purchase in the Cooling-Off Period). If we do not receive the original item back from you with the delivery slip, we may arrange for collection of the item from the delivery address at your cost. Until you return items to us you are responsible for their safe keeping and taking reasonable care of them. We do not accept liability for returned packages damaged during transit back to us. It is your responsibility to wrap products adequately to prevent damage.

Losses 
We will not be responsible to you or any third party for any business loss (including loss of revenue, profits, contracts, anticipated savings, wasted expenditure, data or goodwill) or any other loss or damage which does not result directly from our actions or the actions of our sub-contractors or agents, is consequential or was not reasonably foreseeable to both you and us when the contract between us was formed. Our liability to you under these On-Line Shopping Terms and Conditions will not exceed the total price charged for the items purchased. Nothing in these On-line Shopping Terms and Conditions excludes our liability to you for personal injury or death caused by our negligence.

EVENTS BEYOND OUR REASONABLE CONTROL
We will not be responsible to you for any delay or failure to comply with our obligations under these On-line Shopping Terms and Conditions if the delay or failure arises from any cause beyond our reasonable control.
These terms do not affect your statutory consumer rights.

Notes:
Once a chocolate order has been placed for goods that are in stock, and cleared payment has been received, a courier service will delivery to you within 1-2 days (unless the order is placed on a weekend or bank holiday).
 Once goods have been ordered we will inform you when they have been collected by the courier and give you an idea of a delivery date.When the goods have been collected by the courier and delivery arranged we will not know if the item is successfully delivered. If your order is not received you should call 01875 811387 so that we can find out the problem.

If your order is more than 5 boxes or more than 100kg of chocolate your order may need to go on a pallet. The pallet delivery charge is £35 if you chocolate order is less than £660. Contact us before you order if you need more information.
